1. Definitions

  • Event Beyond Our Control: Any situation outside our reasonable control (explained in section 12)
  • GGF: Glass and Glazing Federation (we are members)
  • Goods: The products listed in your order
  • Guarantee Document: The warranty document attached to these terms
  • Order: Your request for our products and/or services
  • Services: The work we will do for you as listed in your order
  • Subject Property: The building where installation will take place
  • Terms: This document
  • We/Our/Us: Oakview Windows and Doors Ltd
  • You/Your: The customer named in the order

2. Our Agreement With You

  • These terms apply to all goods and services we provide you
  • Please check your order details carefully before confirming
  • Your order isn’t accepted until we send you written confirmation
  • This agreement is our complete understanding—no other promises apply
  • We mainly serve the UK mainland and don’t guarantee service elsewhere
  • Product images are for illustration only—actual products may vary slightly
  • You are responsible for any legal issues arising from specifications you provide
  • We may need to change product specifications to meet regulations

3. Delivery

  • Delivery means either us bringing goods to you or you collecting them
  • We only deliver within UK mainland
  • We’ll provide an estimated delivery date after receiving your deposit
  • We’re only responsible for delivering to the nearest access point of your address
  • If we miss a delivery, our responsibility is limited to the difference in cost between our goods and similar replacement goods
  • If you miss a delivery, we’ll try again but may charge storage costs
  • After 10 working days, we may resell goods you haven’t accepted

4. Ownership

  • We own the goods until you’ve paid in full
  • Until then, you must:
    • Store them separately from other items
    • Keep identifying marks intact
    • Keep them in good condition and insured
    • Tell us if your financial situation changes
  • You may resell them in normal business operations, but you become the seller
  • If your financial situation changes, your right to sell them ends

5. Our Services

  • We’ll provide services from the start date until the completion date in your order
  • We’ll try to finish on time but delays may happen due to circumstances beyond our control
  • We need certain information from you; if not provided, we may charge extra or delay work
  • We may need to suspend services for technical issues or improvements
  • If you don’t pay, we may suspend services
  • If we design goods for you, we own all intellectual property rights

6. Property Survey

  • We may need to survey your property before accepting your order
  • If you order goods without installation, you’re responsible for ensuring measurements are correct

7. Installation

  • We’ll provide an estimated installation start date
  • We’ll install according to relevant regulations and standards
  • Our installers may discover additional work needed that wasn’t apparent earlier
  • You must clear the areas where installation will take place
  • Our liability for property damage is limited to £5,000

8. Product Guarantee

  • We guarantee products as described in the Guarantee Document
  • The guarantee starts from delivery or installation completion
  • Our guarantee doesn’t cover:
    • Normal wear and tear
    • Accidental damage
    • Misuse or neglect
    • Condensation issues
    • Weather damage
    • Installation issues
    • Changes you make
    • Minor glass imperfections
  • You must report defects within 28 days
  • The guarantee is void if:
    • You don’t maintain the products properly
    • You use them outside recommended conditions
    • You haven’t paid in full
    • They’re installed outside UK mainland
  • We may repair, replace, or refund defective components at our discretion
  • If we visit and find no defect, we may charge a call-out fee

9. Price and Payment

  • The price is set in your order but may change until we accept it
  • Prices exclude VAT unless stated otherwise
  • Delivery costs are usually shown separately
  • If we find a pricing error, we’ll contact you
  • Payment is required in advance unless we agree otherwise
  • We may increase prices due to factors beyond our control

10. Our Liability To You

  • We don’t limit our liability for:
    • Death or injury caused by our negligence
    • Fraud
    • Product title and ownership issues
    • Defective products under Consumer Protection Act
  • Otherwise, we’re not liable for:
    • Loss of profit
    • Indirect losses
  • Our total liability won’t exceed what you paid for goods/services

11. Ending The Agreement

  • Either party may end the agreement immediately if the other:
    • Breaks the agreement and doesn’t fix it within 28 days
    • Has financial problems
    • Stops business operations
  • We may end the agreement if you don’t pay on time
  • We may need to cancel before delivery due to events beyond our control
  • If we cancel, we’ll refund any advance payments
  • When the agreement ends:
    • You must pay outstanding invoices immediately
    • You must return any unpaid goods
    • Legal rights existing before termination remain valid

12. Events Beyond Our Control

  • These include strikes, pandemics, utility failures, natural disasters, etc.
  • We’re not responsible for delays caused by such events
  • If these events prevent us from providing goods/services for over 4 weeks, we may cancel the agreement

13. Additional Terms

  • We may transfer our rights and duties to others; you may not without our permission
  • Official notices must be in writing to registered addresses
  • If any part of this agreement becomes invalid, the rest remains valid
  • Not enforcing rights doesn’t mean giving them up
  • This agreement doesn’t create a partnership
  • Except for the guarantee, third parties can’t enforce these terms
  • Changes to these terms must be in writing
  • This agreement is governed by English and Welsh law

14. Acceptance

By signing, you confirm you’ve read and accept these terms and conditions.
